Acceptance of Terms and Conditions

NTUC provides website features and other products and services to you when you visit or use https://www.ntuc.org.sg; and/or the MyNTUC mobile application software and any updates or supplements to it (including any data, content and services in relation to the use thereof) (to be referred to as the/this “mobile app”)

 

Please read these Terms and Conditions (“T&Cs”) carefully. By using NTUC Digital Services (website and/or mobile app), you agree to these T&Cs, and you consent to the collection, use, and disclosure of your personal data as described in these T&Cs. If you do not agree to these T&Cs, you must discontinue the use of NTUC Digital Services. Your use of NTUC Digital Services shall be deemed to be your agreement to be bound by each of the terms set forth below. NTUC can change these T&Cs at any time by posting updated T&Cs on NTUC Digital Services. If any modification is unacceptable to you, you shall cease using NTUC Digital Services immediately. If you do not cease using NTUC Digital Services, you will be deemed to have accepted the change. You are expected to check these T&Cs from time to time to take notice of any changes NTUC has made as they are binding on you.

  6. From time to time this website may also include links to other websites. These links are provided for your convenience but they do not signify that we endorse the said websites. We have no control over the nature, content and availability of those sites. We shall not be liable for any damages or loss arising from your access to those websites. In no circumstances shall the owners and administrators of this site be associated or affiliated in whatever manner with any trade or service marks, logos, insignia or other devices used or appearing on websites to which this site is linked.
  7. Members should post responsibly. The owners and administrators of this site shall not tolerate defamatory or libellous material, obscene content and abusive or intimidating comments. Unless otherwise stated, members may use content from the site as long as such content is attributed to the author of the post. Content (including, but not limited to, information, images, files, sounds and video clips contained on or available through this site) is provided by the owners and administrators of this site and its registered members.
  8. A Member owns all original content and information posted by the said Member on this website and can control how it is shared through the said Member’s privacy and application settings. In addition, for content that is covered by intellectual property rights, like photos and videos ("IP content"), the said Member specifically gives NTUC the following permission, subject to the Member's privacy and application settings.
  9. You grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or in connection with this website (“IP License”). This IP License ends when you delete your IP content or your account unless your content has been shared with others, and they have not deleted it.
  10. You will not assume a false identity or the identity of another user when using this website, and you will not use this website for unlawful or illegal activities, including but not limited to spamming, harassing or otherwise causing distress to other users.
  11. When you delete the IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others).
  12. When you add an application and use our website, your content and information is shared with the application. We require applications to respect your privacy settings, but your agreement with that application will control how the application can use the content and information you share.
  13. When you publish content or information, it means that everyone will have access to that information and we may not have control over what they do with it.
  14. We always appreciate your feedback or other suggestions about our website, but you understand that we may use them without any obligation to compensate you for them (just as you have no obligation to offer them).

Under no circumstances shall the owners and administrators of this site be considered to be associated or affiliated in whatever manner with any trade or service marks, logos, insignia or other devices used or appearing on websites that link to http://www.ntuc.org.sg/ or any of the contents.
  16. NTUC reserves all rights to deny or restrict access to this site to any particular person, or to block access from a particular Internet address to this site, at any time, without ascribing any reasons whatsoever.
  17. NTUC is not responsible for any material submitted to the public areas by you (which include bulletin boards, hosted pages, chat rooms, or any other public area found on the website. Any material (whether submitted by you or any other user) is not endorsed, reviewed or approved by the NTUC. NTUC shall have the right (but not the obligation) at our sole discretion to pre-screen, refuse, move or remove any content that is available via the website. Without limiting the foregoing, NTUC shall have the right to remove any content (whether or not provided by you) that we believe in good faith violates the terms and conditions for the use of U Portal or that has been alleged to infringe any intellectual property rights or that contains marketing or promotional material which is intended to solicit business or that is otherwise objectionable in our sole opinion, without being liable to you in any way for any loss or damage arising from such removal.
  18. You further agree not to use the website to send or post any message or material that is unlawful, harassing, defamatory, abusive, indecent, threatening, harmful, vulgar, obscene, sexually orientated, racially offensive, profane, pornographic or violates any applicable law including any law relating to intellectual property rights, or to post or upload files that contain viruses, corrupted files or any other similar software or programmes that may damage the operation of NTUC's and/or a third party's computer system and/or network, and you hereby agree to fully indemnify NTUC against any loss, liability, damage or expense of whatever nature which NTUC or any third party may suffer which is caused by or attributable to, whether directly or indirectly, your use of the website to send or post or upload any such message or material.
  19. Every effort is made to keep the website up and running smoothly. However, NTUC takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control.
  20. On registration, you must provide NTUC with complete and accurate information. NTUC is entitled to rely on any registration information you provide unless and until such information is updated by you via this website.
  21. You agree that any personally identifiable information which you provide to us through this website may be collected by NTUC and used for various purposes, including without limitation:
    • To provide goods and services by NTUC or its designated representatives, related organisations or business partners to you or parties designated by you and matters ancillary thereto;
    • To verify and process payment when you purchase goods and services through this website;
    • To verify and record your personal particulars and to use the information to communicate with you;
    • To send you information, promotions and updates including marketing and advertising materials in relation to goods and services of NTUC, its affiliates and related organisations;
    • To conduct statistical and other analysis of users of our website; and
    • To comply with any order of court or directive from authorities investigating any alleged offence, misdeeds and/or abuse or for the purpose of taking any legal action against any users for breach of these Terms and Conditions.
  22. For payments made through this website, you agree to follow and accept all instructions and information in this website when performing a transaction, to provide information which is true, current, complete and accurate when performing a transaction, not to perform any speculative, false or fraudulent transaction, and to pay any and all fees in respect of your transaction. NTUC reserves the right to cancel or reject your transaction without refund or paying any compensation to you if any transaction details or communication you have provided are not current or are incomplete, inaccurate, or false.
  23. NTUC and/or its affiliates or related organisations or content providers shall not be liable for any direct, indirect or consequential loss or damage of any kind occasioned from the reliance upon the contents contained in or available from this website, the performing of any transaction or communication on this website, and/or the use or inability to use this website, resulting from inaccuracies, neglect, defects, errors, omissions, outdated information or otherwise.
  24. The opinions expressed by individuals providing comments are theirs alone and may not necessarily reflect the opinions of the owners and administrators of this site. NTUC therefore shall not be responsible for the accuracy of any of the information supplied by the users of the site in relation to any comments that are posted. You should bear in mind that circumstances change and that information that may have been accurate at the time of posting may not necessarily remain so. You agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against NTUC with respect thereto.
  25. You agree not to circumvent, disable or otherwise interfere with security-related features of this website or features that prevent or restrict use or copying of any content or enforce limitations on the use of this website or the content therein.
  26. We respect the intellectual property of others, and we ask our users to do the same. If you believe that your intellectual property right has been infringed, please notify us at ntuc.co/chat. Upon receipt of a complaint of infringement, we will expeditiously take reasonable steps to remove or disable access to the allegedly infringing electronic copy and expeditiously take reasonable steps to notify the person who had made that electronic copy available (“Content Owner”). We may also, in appropriate circumstances and at our sole discretion, disable and/or terminate without notice the accounts of users who may be infringing the intellectual property rights (including but not limited to copyrights and trademarks) of others. In particular, we will terminate the accounts of users whom we have determined (in our sole discretion) to be repeat infringers.

If you continue to use this mobile app, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern NTUC's relationship with you as a registered user in relation to this mobile app.

Please read these Terms and Conditions carefully before you start to use the mobile app, as these will apply to your use of the mobile app. The ways in which you can use the mobile app may also be controlled or be affected by Apple Store’s or Google Play's rules and policies, as well as other separate terms, conditions and policies that may govern the access and use of other mobile applications, platforms and/or websites that may be linked to this mobile app.

For the avoidance of doubt, “NTUC”, “we”, “our” or “us” in these terms and conditions shall refer to the National Trades Union Congress. We hereby grant you a personal, non-transferrable, non-exclusive licence to use the mobile app, on and subject to the following terms and conditions:

  1. These Terms and Conditions are subject to change from time to time, as NTUC may decide in NTUC’s sole discretion. All changes will be effective once they are posted in this mobile app, and your continued use of this mobile app after such changes have been posted will constitute your agreement to the modified Terms and Conditions.

  2. In addition, particular services added or offered through this mobile app may be subject to additional terms, instructions or guidelines, which shall be deemed incorporated in these Terms and Conditions by reference.

  3. We may automatically update this mobile app from time to time, and we may delete, amend or otherwise vary any data, content and services in relation to this mobile app at any time at our sole discretion. Alternatively, we may ask you to update this mobile app for security reasons. If you choose not to install such updates or opt out of automatic security updates, you may be open to cyber-attacks and eventually the mobile app may not be usable if it is not compatible with the latest working version.

  1. In return for your agreeing to comply with these terms and conditions you may:
    • download a copy of the mobile app and view, use and/or display the mobile app on such devices for your personal purposes only;
    • use the mobile app for such purposes permitted by these terms and conditions; and
    • receive and use any free updates of the mobile app we may provide to you.

  2. If you download the mobile app onto any phone or other device not owned by you, you must have the owner's permission to do so. You shall be responsible for complying with all these terms and conditions, whether or not you own the phone or other device.

  3. You shall not assume a false identity when using this mobile app. On registration, you must provide NTUC with complete and accurate information. NTUC is entitled to rely on any registration information you provide unless and until such information is updated by you via this mobile app or via such other external sources that are integrated/linked to this mobile app as NTUC may prescribe.

  4. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as strictly confidential and must not disclose such information to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our sole opinion you have failed to comply with any of the provisions of these terms and conditions.

  5. You agree to use the mobile app in accordance with any additional instructions and/or guidelines that we may prescribe from time to time.

  6. We are giving you personally the right to use the mobile app in accordance with these terms and conditions. You may not transfer the mobile app to someone else. If you sell any device on which the mobile app is installed, you must remove the mobile app from it.

  7. You agree that you shall:
    • not rent, lease, sub-license, loan, provide, or otherwise make available, the mobile app in any form, in whole or in part to any other person;
    • not copy the mobile app or any part thereof, except as part of the normal use of the mobile app or where it is necessary for the purpose of back-up or operational security;
    • not translate, merge, adapt or modify, the whole or any part of the mobile app nor permit the mobile app or any part thereof to be combined with, or become incorporated in, any other programs, except as necessary to use the mobile app on devices as permitted by these terms and conditions;
    • not disassemble, de-compile, reverse engineer or create derivative works based on the whole or any part of the mobile app nor attempt to do any such things, except as permitted under relevant laws;
    • not circumvent, disable or otherwise interfere with security-related features of the mobile app or features that prevent or restrict use or copying of any content or enforce limitations on use of the mobile app or the content therein; and
    • comply with all applicable technology or laws and regulations that apply to the technology used or supported by the mobile app.

  8. Further, you shall not:
    • use the mobile app in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these terms and conditions, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, such as viruses, or harmful data, into the mobile app and/or any operating system;
    • infringe our intellectual property rights or those of any third party in relation to your use of the mobile app (to the extent that such use is not licensed by these terms and conditions);
    • transmit any material that is unlawful, defamatory, offensive or otherwise objectionable in relation to your use of the mobile app;
    • use the mobile app in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users; and
    • collect or harvest any information or data from the mobile app and/or our systems or attempt to decipher any transmissions to or from the servers running any service in connection with the mobile app.

  9. NTUC reserves all rights to deny or restrict access to this mobile app to any particular person, or to block access to this mobile app, at any time, without ascribing any reasons whatsoever.

The information contained in this mobile app is for general information purposes only and does not represent legal or other professional advice. Whilst we endeavour to keep the information up-to-date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability of the information contained on this mobile app for any purpose whatsoever. All intellectual property rights in the mobile app belong to us (or our licensors) and the relevant rights in the mobile app are licensed (not sold) to you. You have no intellectual property rights in, or to, the mobile app other than the right to use the mobile app in accordance with these terms and conditions.

  1. From time to time, this mobile app may also include links to other mobile applications, platforms and/or websites (collectively, the “Other Platforms”). These links are provided for your convenience but they do not signify that we endorse any of the Other Platforms. We have no control over, neither have we checked nor approved, the nature, content (including any terms, conditions and policies) and availability of any of the Other Platforms. We do not in any way represent, warrant or undertake in any way, any of the information (nor the legality, completeness, accuracy, reliability or suitability of such information) that may be provided, uploaded, made available or published on any of the Other Platforms. We shall not be liable or held responsible (and you shall not claim against us): (a) for any conduct, act, omission or negligence of the owners or administrators of any of the Other Platforms; and/or (b) for any damages or loss arising from your use of or access to any of the Other Platforms (including but not limited to your reliance on the contents made available as well as the performing of any transaction or communication, on any of the Other Platforms) and/or your inability to use any of the Other Platforms.

    For the avoidance of doubt, your use of and/or access to the Other Platforms may be governed by separate terms, conditions and policies (of which we have no control over) as may be determined by other third parties.

  2. You agree that any personally identifiable information which you provide to us through this mobile app may be collected by NTUC and used for various purposes, including without limitation:
    • To provide goods and services by NTUC or its designated representatives, related organisations or business partners to you or parties designated by you and matters ancillary thereto;
    • To verify and process payment when you purchase goods and services through this mobile app;
    • To verify and record your personal particulars and to use the information to communicate with you;
    • To send you information, promotions and updates including marketing and advertising materials in relation to goods and services of NTUC, its affiliates and related organisations;
    • To conduct statistical and other analysis of users of our mobile app; and
    • To comply with any order of court or directive from authorities investigating any alleged offence, misdeeds and/or abuse or for the purpose of taking any legal action against any users for breach of these Terms and Conditions.

  3. For payments made through this mobile app:
    • You agree to follow and accept all instructions and information in this mobile app (as well as in accordance with all terms and conditions that may be required by such third party vendors/providers/owners of any electronic payment platforms/services in connection with such payments) when performing a transaction, to provide information which is true, current, complete and accurate when performing a transaction, not to perform any speculative, false or fraudulent transaction, and to pay any and all fees in respect of your transaction. NTUC reserves the right to cancel or reject your transaction without refund or paying any compensation to you if any transaction details or communication you have provided are not current or are incomplete, inaccurate, or false.
    • Payment information is transmitted through a secured payment channel using our secure server and Secure Socket Layer. Payment will be made based on the payment mode selected by you in this mobile app for online membership sign up, membership fees renewal and other available products offered by NTUC. Once payment mode has been selected and payment has been submitted, any changes to the payment mode with regards to the payment is not possible.
    • This mobile app provides online means for you to apply and authorize payment by way of VISA and Mastercard™ debit and credit cards – with the added security of the respective 3-Domain Secure services, Mastercard™ Identity Check™ (SecureCode™), Verified by Visa and SafeKey 2.0. The secure 3-Domain process will be required with certain payments that safeguards the payment through an additional authentication process, thereby providing additional security when processing your card data. The additional authentication process is individually defined and undertaken outside of this mobile app by Mastercard Payment Gateway services (MPGS) once your card details have been entered and verified. NTUC does not store or collect your credit cards details for payments made through this mobile app.
    • For the avoidance of doubt, you confirm and undertake that: (a) you are the cardholder of the relevant credit/debit card (the details of which are provided for such payment(s)); or (b) you have obtained consent from the cardholder of the relevant credit/debit card (the details of which are provided for such payment(s)) to use the cardholder’s credit/debit card for such payment(s), as the case may be. Without prejudice to the generality of Clause 17(a) above and any other remedy NTUC may have, you further agree to fully indemnify NTUC for and against any liabilities, claims, damages or losses that NTUC may suffer or incur pursuant to your breach of this undertaking.
    • This mobile app also accepts payment by way of DBS FAST Collection, GIRO and PayNow (DBS MAX) for one-time payment and/or recurring payment arrangement that are authorised by you.
    • All payment transactions made within this mobile app are secured using GCM cipher mode encryption.

  4. Other Obligations of Registered Users of Mobile App
    By using the mobile app, you further warrant, represent and undertake:
    • you have correctly and accurately disclosed all the information required in connection with the use of the mobile app;
    • you have the capacity and authority to agree to these terms and conditions, and further that you are of legal age to use the mobile app in accordance with these terms and conditions and to create binding legal obligations for any liability you may incur as a result of the use of the mobile app; and
    • you will use the mobile app in accordance with these terms and conditions.

  5. For the avoidance of doubt, you agree that any feedback or suggestion you may provide to us concerning this mobile app may (if applicable) be used by us without any obligation to compensate you in any way whatsoever.

Without prejudice to any other provision in these terms and conditions and/or any other remedy NTUC may have in connection thereto, you shall indemnify and keep NTUC fully indemnified, from and against all liabilities, claims, demands, damages, losses, penalties, costs and expenses which may be suffered or incurred by NTUC in connection with your breach of any of these terms and conditions.

To the fullest extent permissible by Singapore law, NTUC shall not be liable to you for any loss or damage of any kind, whether in contract, tort (including negligence) or otherwise, arising under or in connection with your reliance upon the contents contained in or otherwise available from the mobile app as well as your use of (including the performing of any transaction or communication on the mobile app), or inability to use, the mobile app.

 

Without limiting the generality of the foregoing, NTUC shall not be liable for: (i) any loss of profits, income, business or revenue; (ii) any loss of business opportunity, goodwill or reputation; (iii) any loss or damage caused by a virus or other technologically harmful material that may infect your computer equipment, computer programs or data due to your download or use of the mobile app; and/or (iv) any loss or damage in relation to any error, failure, delay, interruption, suspension, breakdown, outage, maintenance, repair, inspection, modification and/or problem of the mobile app (as well as any of the Other Platforms that may be linked to this mobile app), NTUC’s computer and information systems (as well as any equipment, software, programs and/or firmware in relation thereto) and/or that of any of NTUC’s third party service providers, howsoever arising.

 

For the avoidance of doubt, this clause shall not apply to any liability that cannot be excluded or limited by Singapore law (including liability for death or personal injury arising from NTUC’s negligence).

  1. NTUC has the right to immediately terminate your right to use the mobile app at any time by giving such notice to you, if you breach or otherwise fail to adhere to any of these terms and conditions. In the event of any such termination: (a) you must stop all activities authorised by these terms and conditions, including your use of the mobile app; and (b) you must delete or remove the mobile app from all devices in your possession and immediately destroy all copies of the mobile app which you have.

  2. Any term or condition that expressly or by implication is intended to come into or continue in force on or after any termination (including but not limited to Clauses 13 to 16, and Clauses 20 to 29) shall remain in full force and effect in accordance therewith.

A person who is not a party hereto shall have no right under the Contracts (Rights of Third Parties) Act (Cap. 53B) of Singapore to enforce any of these terms and conditions.

No failure by us to exercise, and no delay on our part in exercising, any right or remedy hereunder or by law will operate as a waiver thereof, nor will any single or partial exercise of any right or remedy by us preclude or restrict any other or further exercise thereof or the exercise of any other right or remedy.

If any provision in these terms and conditions is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted. Any modification to or deletion of a provision pursuant to this clause shall not affect the validity and enforceability of the rest of these terms and conditions.

  1. These terms and conditions shall be governed by and construed in accordance with Singapore law

  2. Parties shall make every effort to reach a mutually satisfactory resolution of any dispute, claim, question or disagreement (a “Dispute”) in connection with or arising out of these terms and conditions through cooperation, consultation and dialogue.

  3. If a mutually satisfactory resolution cannot be reached within a period of forty-five (45) days from the date a party communicates the subject of the Dispute to the other party, the Courts of Singapore shall have jurisdiction in the case of any Dispute in connection with these terms and conditions.
